ToYou Loyalty Program Terms and Conditions

1. General
Welcome to the ToYou Loyalty Program (“Program”). By participating in the Program, you agree to the following terms and conditions (“Terms”). These Terms are subject to and in addition to ToYou’s Terms and Conditions of Use and Privacy Policy. In case of any conflict, ToYou’s general Terms and Conditions will prevail. Any terms not defined in these Terms shall have the meanings given to them in the general Terms and Conditions.
2. Participation
2.1 The Program is offered at the sole discretion of ToYou. The Program is open to all registered ToYou users (“Members”) for their personal use only and is limited to one account per individual. Membership is not available for use by Members under the age of majority in Saudi Arabia. Member may not authorise third parties to use the Program. Member agrees to comply with all applicable Saudi laws when using the Program, and Member may only use the Program for lawful purposes. Membership is automatic upon account creation. Each Member is assigned a tier level (“Tier”) based on their activity and points earned through eligible orders. The Tiers will be available and visible on the Application.
2.2 Members can earn points on product purchases and/or services as specified and determined by ToYou calculated based on the total order costs. You will also not earn points for qualifying products and services made prior to Program enrollment.
2.3 ToYou shall determine, from time to time, in its sole discretion, which products and/or services are eligible for inclusion in and/or exclusion of the Program.
2.4 Points and benefits cannot be transferred or redeemed for cash unless explicitly stated. Participation in the Program constitutes acceptance of these Terms.
3. How the Program works
3.1 You are able to earn points and also unlock Program loyalty Tiers by making eligible orders on the Application. You will receive points on qualifying orders and the number of points will depend on the merchant with whom the order was made. Each merchant has its own reward of points per SAR 1 spent on a qualified order with the merchant.
3.2 Once you have accumulated points and/or unlock a certain loyalty Tier, you may be eligible for certain benefits and rewards applicable to that Tier, which benefits and rewards may change from time to time and may be offered on a limited basis.
3.3 The Program is a tier-based program determined by the number of accumulated points during a specific period of time. There are 4 tiers with associated benefits: Tier Blue; Tier Gold; Tier Platinum; and Tier Black.
3.4 Upon Program enrollment, Members will automatically be placed in Tier Blue. Once Members earn the number of points as determined and specified by ToYou, in its sole discretion, for each of the four Tiers by ToYou and within the time limits as determined and specified by ToYou, Members will be automatically qualified for the next Tier. Each Tier has a specific number of points to earn and an expiry date.
3.5 ToYou reserves the right to change Program benefits, how you unlock each Tier and how ToYou evaluates and rewards your eligible orders and/or other Program activity. ToYou reserves the right to place limits on the number of orders or activities that are eligible for the Program and/or for any given Tier, the number or types of rewards or benefits you may receive or earn in any given Tier, in a given time period or for the duration of the Program, and/or any combination thereof.
4. Earning Points
4.1 Points are earned by completing eligible delivery orders. The number of points earned depends on the merchant’s specific settings. Each merchant defines how many points are awarded per 1 SAR spent, and some merchants may offer no points for orders. Details are available in the Application.
4.2 Higher Tiers provide additional benefits, such as a points multiplier that increases the number of points earned per order. The specific multiplier for each Tier is displayed in the Program section of the Application.
4.3 Certain products and/or services may be excluded from earning points in the sole discretion of ToYou. Digital products are excluded from and not eligible for the Program.
4.4 Points may have a limited validity period that varies by Tier. Each points transaction is assigned an expiration date based on the Member’s active Tier at the time of earning. Member’s Tier will be re-evaluated based on the total points earned during the six months(or any other period determined by ToYou in its sole discretion) preceding the expiry date. The Member may retain their current Tier, be upgraded to a higher Tier, or be downgraded to a lower Tier based on their activity at the sole discretion of ToYou. All unused points will expire and be forfeited on the expiry date specified for each Tier. On the expiry date, Member points will be reset to zero and Member may start accumulating new points and earning new point rewards. Expired points will be removed from the Member’s account automatically.
5. Redeeming Points
5.1 Points can be redeemed for ToYou Wallet balance using predefined bundles shown in the Application. Redemption is subject to the following conditions:
· The redemption rate (e.g., 1 SAR = X points) and available bundles are displayed in the Program section.
· Members must meet the minimum points threshold for the smallest bundle to redeem points.
· Some bundles may include bonus value for the redeemed points.
5.2 Once you have redeemed your point reward, your points balance will be reduced by the applicable points value for that reward. You must redeem your available points/rewards on or prior to the expiry date.
5.3 Neither accounts nor Program rewards, benefits and/or points may be transferred, shared or combined. Only the member paying for the product(s) may accumulate rewards, benefits and/or points. Members will not receive rewards, benefits and/or points on purchases which are reimbursed by corporations or other organizations ineligible to participate in the Program. We reserve the right to monitor the number of accounts per household and refuse, merge or close additional or duplicate accounts at any time. Your account information (including security details) is confidential and should not be shared by you with any other person.
5.4 Rewards, benefits and/or points earned through the Program have no cash value, are non-transferable, and you have no property rights in or to rewards or other Program benefits. Points credited to your Program account will be decreased or reversed, as applicable, if part or all of the purchase is returned or cancelled or if the credit is obtained through fraudulent or other activity that violates these Program Terms. The sale, barter, transfer, or assignment of any rewards, benefits or points offered through the Program, other than by us, is expressly prohibited.
5.5 Rewards cannot be exchanged or returned for points, another product, service or a monetary refund.
5.6 The products and services available through the Program and any samples that we may provide to you are for personal use only. You may not sell or resell any of the products, services, or samples you purchase or otherwise receive from us. We reserve the right, without notice, to cancel or reduce the quantity of any order to be filled and/or any products or services to be provided to you that we believe, in our sole discretion, may result in the violation of our Program Terms.
5.7 We reserve the right in accordance with section 6 below to:
· change Program benefits, how you reach each Program tier, how you earn points and how we evaluate and reward your eligible purchases and/or other Program activity;
· place limits on the number of purchases or activities that are eligible for the Program and/or for any given tier or point level, the number or types of rewards or benefits you may receive or earn in any given tier or at any given point level, in a given time period or for the duration of the Program, and/or any combination thereof.
6. Program Changes
6.1 ToYou reserves the right to modify or terminate the Program at any time, including its features, Tiers, benefits, points earning and redemption rules, and these Terms, and/or do any act with respect to the Program or any part thereof, including withdrawing or changing membership criteria, changing the value and/or validity of the points, at any time without any liability on ToYou. Members acknowledge and agree that any of the foregoing acts may diminish the redemption of the points already earned by the Members and Members shall not claim compensation. Members are responsible for staying informed of the current Program Terms, and continued participation in the Program constitutes acceptance of any modifications.
6.2 ToYou may also terminate the Program, in whole or in part, at its discretion. In such cases, any unredeemed points will be forfeited after a notice period, and ToYou assumes no further liability or obligation.
6.3 ToYou may suspend or terminate a Member’s participation in the Program if they violate these Terms or engage in fraudulent activity. Points and benefits may be forfeited in such cases.
6.4 ToYou may cancel, modify, restrict or terminate these Terms and/or the Program or any aspect or feature of the Program from time to time, and such changes may affect the value of rewards or benefits already accumulated or earned and/or the ability to redeem accumulated rewards or benefits. We will use reasonable endeavours to provide advance notice to you of any material changes to or the cancellation, modification or restriction of these Terms and/or the Program in writing, email, SMS, MMS or by posting it Online or our other channels. You should review these Terms frequently to understand the terms and conditions that apply to the Program.
6.5 ToYou reserves the right to exclude Members from or to discontinue Members’ participation in the Program and to audit Member’s membership account at any time, in ToYou sole discretion. Any suspected abuse of the Program, failure to follow any sections of these Terms, illegal activity, fraud, misrepresentation or other conduct which ToYou considers to be inconsistent with these Terms and/or detrimental to us or our interests, including without limitation, any suspected illegal, fraudulent other unauthorized use of any Program rewards, points, cards, credits, vouchers, coupons and/or certificates, may result in the revocation of your membership and make you ineligible for further participation in the Program. If your membership is revoked, any rewards or benefits in your account will automatically expire and your access to the Program and features will automatically terminate. If we suspect illegal activity, fraud, misrepresentation, abuse or violation of these Terms, we also have the right to take appropriate legal action, in our sole discretion
7. Liability
ToYou shall not be held responsible for any direct or indirect consequences associated with any force major events or malfunction beyond its control, and/or any direct or indirect consequences associated with the Member's non-accordance use or fraudulent use with these Terms.
